2. General information on data processing
We process personal data only to the extent necessary to provide this website as well as our content and services. The legal bases are in particular Art. 6(1)(a) (consent), (b) (contract or pre-contractual measures) and (f) (legitimate interest) GDPR.
3. Visiting the website (server logs)
When you visit the website, our hosting provider processes technically necessary data (IP address, date and time, browser, referrer). Legal basis: Art. 6(1)(f) GDPR (secure operation of the website). The data is deleted after 30 days at the latest.
4. Contacting us by email
If you write to us by email, your local email program will open. The information you provide (e.g. name, email address, your situation and goals) is sent exclusively to the email addresses named above. No transmission to servers of this website takes place.
We process this data to handle your request and for pre-contractual measures (Art. 6(1)(b) GDPR). If you voluntarily provide further information, this is processed on the basis of your consent (Art. 6(1)(a) GDPR). Your data is deleted after the inquiry or contract phase is completed, unless statutory retention obligations apply (generally 6 months; up to 10 years after conclusion of a contract pursuant to the German Fiscal Code (AO)/Commercial Code (HGB)).
Emails are sent unencrypted via your email provider. If you would like a secure transmission, please contact us via an encrypted channel.
5. Appointment booking via Calendly (only with consent)
We use Calendly for booking the free initial consultation (Calendly LLC, 271 17th St NW, Atlanta, GA 30363, USA). The booking widget is not loaded automatically: a placeholder is displayed first and is only loaded once you expressly consent ("Load calendar" or "Allow Calendly").
Only after your consent are connection data (including IP address, browser information) transmitted to Calendly; when booking, the information you provide, such as name, email address, requested appointment and optional answers, is also transmitted. Calendly may set its own cookies in the process.
The legal basis for loading the widget and setting the associated cookies is your consent (Art. 6(1)(a) GDPR in conjunction with Sec. 25(1) TDDDG); for the subsequent handling of the appointment, Art. 6(1)(b) GDPR. Data may be transferred to the USA; Calendly bases such transfers on Standard Contractual Clauses (SCC). Further information: calendly.com/de/privacy.
Data recipients: Calendly LLC and processors engaged by Calendly (cloud hosting and email delivery service providers, located among other places in the USA and the EU). An overview of the sub-processors can be found at calendly.com/legal/sub-processors.
Retention period: Your booking data (name, email, appointment, answers) is retained by us for the duration of the business correspondence and beyond that for six years (commercial and tax law, Sec. 257 HGB, Sec. 147 AO). Calendly's own retention periods apply to data held by Calendly; you can request earlier deletion via support@calendly.com.
You can withdraw your consent at any time with effect for the future – via the "Cookie Settings" page, which you can find in the footer of every page. Withdrawal does not affect the booking already made.
6. Hosting
This website is hosted by an external service provider. A data processing agreement pursuant to Art. 28 GDPR is in place with the provider.
7. Cookies & consent management
This website does not use tracking cookies, analytics tools or marketing tools (no Google Analytics, no Meta Pixel, no retargeting). No profiling takes place. Fonts are served locally from our server; there is no connection to Google Fonts.
For technical necessity, we only store your decision regarding external content locally in your browser (localStorage entry "somapreneur-consent-external-media") so that the notice does not reappear on every visit. Legal basis: Sec. 25(2) No. 2 TDDDG or Art. 6(1)(f) GDPR (legitimate interest in functioning consent management). Data recipients: none. Retention period: until manually deleted in your browser or until you change the cookie settings.
Further cookies are only set following your consent, by the embedded Calendly calendar (see item 5). Legal basis: Art. 6(1)(a) GDPR in conjunction with Sec. 25(1) TDDDG. Data recipients: Calendly LLC (USA) and its processors. Retention period: depending on the Calendly cookie type, from end of session up to six months; details at calendly.com/de/privacy.
You manage your selection by category (necessary, external media, statistics, marketing) on the "Cookie Settings" page in the footer – where you can change or fully withdraw it at any time. Your selection, the time of the decision and the version of the notice are stored exclusively locally in your browser.
8. Clarity Check: result by email (consent record)
If you ask us to email you your Clarity Check result, we process your email address, optionally your first name, your result (bottleneck and score per area) and the language of the page. Legal basis: your consent (Art. 6(1)(a) GDPR).
To be able to demonstrate your consent, we additionally log the exact wording and version identifier of the consent text, the time of your consent, the page you consented on, your IP address and your browser identifier (user agent). Legal basis: Art. 6(1)(c) in conjunction with Art. 7(1) GDPR (obligation to demonstrate consent) and our legitimate interest in preventing misuse and unauthorised sign-ups (Art. 6(1)(f) GDPR).
Recipients: our hosting and database provider and our email delivery provider, each as processors under Art. 28 GDPR. Retention: until you withdraw your consent; the proof data is kept for up to three further years (limitation periods) and then deleted.
You can withdraw your consent at any time via the unsubscribe link in every email or by writing to hello@somapreneur.de. On request we will send you the consent record stored about you.
9. Social media
If you click on external links to our social media profiles, the privacy policy of the respective platform applies. We have no influence on the data collected there. Embedded content (e.g. Instagram posts) is not automatically loaded on this website.
